Waiver of Liability and Release Agreement

PLEASE READ CAREFULLY. BY ENTERING THE FACILITY AND GROUNDS OF NEXT LEVEL ATHLETICS LLC, YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS:

I acknowledge and understand that participation in batting cage, field, and training activities at Next Level Athletics LLC involves inherent risks of injury, illness, or property damage, including but not limited to being struck by balls or equipment, slips or falls, collisions, or other accidents associated with athletic activity.
By entering the premises, I voluntarily assume all risks, known and unknown, even those arising from the negligence of Next Level Athletics LLC, its owners, employees, agents, or other participants.

In consideration for being permitted to use the facilities and equipment, I hereby release, discharge, and hold harmless Next Level Athletics LLC, its owners, officers, employees, contractors, affiliates, and agents from any and all liability, claims, demands, or causes of action arising out of or related to any loss, injury, or damage to person or property, whether caused by negligence or otherwise.
This release applies to all claims known and unknown, foreseen and unforeseen.

I agree to comply with all posted, written, and verbal rules, including safety instructions, equipment usage guidelines, and reservation policies. I understand that failure to follow facility rules or staff directions may result in removal from the premises without refund or credit.

I acknowledge and agree that I am financially responsible for any damage to the facilities, equipment, or property of Next Level Athletics LLC caused by my actions or the actions of my guests, team members, or anyone under my supervision.
Next Level Athletics LLC reserves the right to charge the cost of repair or replacement to the responsible party and to pursue any additional remedies permitted by law.

I affirm that I am physically fit and capable of participating in athletic activities. I assume full responsibility for any medical conditions or injuries that may occur while on the premises. In the event of an emergency, I authorize Next Level Athletics LLC to secure medical treatment deemed necessary and accept full financial responsibility for any related costs.

I grant permission to Next Level Athletics LLC to use photographs, videos, or other recordings of me for marketing, promotional, or training purposes without compensation or further approval.

If the participant is under 18 years of age, I, the parent or legal guardian, consent to their participation and agree to all terms of this waiver and release on their behalf. I accept full responsibility for the minor’s conduct, supervision, and safety while on the premises.

Coaches and team representatives are responsible for ensuring that all players and guests have agreed to this waiver prior to participation. Coaches must supervise their teams at all times and ensure adherence to all rules, safety policies, and staff instructions.

This agreement shall be governed by and construed in accordance with the laws of the State of Texas. If any provision is found to be invalid or unenforceable, the remaining terms shall remain in full force and effect.
